This page contains two sets of terms. Please select the version that applies to you:



PART 1 — Consumer Terms of Sale (Individuals)

These Consumer Terms of Sale apply to all purchases made by individual consumers — natural persons not acting in a professional or business capacity — through our webshop. By completing a purchase, you agree to be bound by these Terms.

1. Definitions

Content Provider: The party that prepares, hosts and delivers the training content accessible via the DiviTrain portal.

Product: A time-limited, personal, non-transferable access licence to online IT training content on the DiviTrain portal.

Access Credentials: The login details and portal URL sent to you by email after purchase.

Activation: The moment you start your first course within the portal. A notification is shown in the portal before this occurs.

Access Period: 365 consecutive calendar days beginning at Activation.

Exam Voucher: Not included in any Product unless explicitly stated on the product page. Exams must be booked separately via an authorised exam provider such as Pearson VUE.


2. What You Are Buying

You are purchasing a licence to access online IT training content made available through the DiviTrain portal. You are not purchasing:

  • A download or permanent copy of any content;
  • Ownership of any content;
  • An exam voucher or exam registration;
  • Consultancy, coaching or custom content.

Course availability is subject to the Content Provider's catalogue. If a purchased course becomes unavailable, DiviTrain will offer a comparable alternative or a refund (see Section 6).


3. Ordering & Payment

Orders are placed via www.divitrain.com. Payment is processed by Shopify Payments on behalf of DiviTrain. All prices are inclusive of VAT where applicable. The applicable VAT amount is shown at checkout.

VAT for EU consumers: VAT is charged at the rate applicable in your country of residence, in accordance with EU VAT rules for electronically supplied digital services.

VAT for consumers outside the EU: No Dutch VAT is charged. Your purchase may be subject to local taxes or import duties in your country; DiviTrain is not responsible for those.

Your order constitutes an offer to purchase. DiviTrain accepts your offer upon sending your Access Credentials. The contract is concluded at that moment.


4. Delivery

Access Credentials (login details and portal URL) are delivered automatically to the email address provided at checkout, typically within a few minutes of successful payment. Delivery is deemed complete when the Access Credentials email is sent.

If you do not receive your Access Credentials within 2 hours of payment, please check your spam folder before contacting us at support@divitrain.com. DiviTrain is not responsible for non-delivery caused by an incorrect email address entered at checkout.


5. Activation & 365-Day Access

Your 365-day Access Period begins at Activation — the moment you start your first course. A notification is displayed in the portal before your first course start to confirm this. Once activated, your access runs continuously for 365 days regardless of actual usage.

Important: We strongly recommend you are ready to begin learning before activating your course. Starting a course starts the 365-day clock immediately.


6. Cancellation, Right of Withdrawal & Refund Policy

6.1. Customers in the European Union and United Kingdom

Under EU law (Consumer Rights Directive 2011/83/EU) and equivalent UK law, you normally have a 14-day right of withdrawal on distance purchases. For digital content, this right expires once delivery has begun — provided you gave your prior consent at checkout.

By completing your purchase, you expressly requested immediate delivery of your Access Credentials. Your statutory right of withdrawal therefore expired at the moment your Access Credentials were sent to you. This is a requirement of EU and UK law and applies to all digital content providers — it is not a policy choice by DiviTrain.

6.2. Customers outside the European Union and United Kingdom

No statutory right of withdrawal applies to this purchase under your local law. DiviTrain's voluntary refund policy in Section 6.3 applies to you.

6.3. DiviTrain's voluntary refund policy (applies to all customers worldwide)

Regardless of the statutory position above, DiviTrain voluntarily offers the following:

  • Access Credentials not yet sent: You are entitled to a full refund. Contact us at support@divitrain.com before delivery is made.
  • Access Credentials sent — first course not yet started: Contact us at support@divitrain.com within 7 days of receiving your credentials. We will assess your request at our discretion.
  • First course started (Activation): No refund is possible. Starting your first course activates your 365-day access period. The digital content has been consumed from that moment. A clear notification is shown in the portal before your first course starts so you can make an informed decision.
  • Purchased course entirely unavailable due to Content Provider: DiviTrain will offer a comparable replacement or, if unavailable, a pro-rata refund for the unused portion of your access period.
  • Verified technical defect preventing access, attributable to DiviTrain or the Content Provider: Full refund or replacement after verification.

Nothing in this Section limits any mandatory consumer rights you may have under the laws of your country of residence. To request a refund, contact support@divitrain.com with your order number.


7. Licence & Prohibited Use

Your licence is personal, non-transferable and non-commercial. You agree not to:

  • Share, sell, sublicense or transfer your Access Credentials to any third party;
  • Use the content to train third parties commercially;
  • Copy, record, reproduce or redistribute any training content;
  • Attempt to reverse engineer or extract content from the portal.

Violation of these terms may result in immediate access termination without refund.


8. Intellectual Property

All training content is owned by or licensed to the Content Provider and/or the underlying content publishers. DiviTrain owns its website, brand assets and portal configuration. Nothing in these Terms grants you any intellectual property rights in the content.


9. Content Provider & Platform

The training content is hosted and delivered by the Content Provider via the DiviTrain portal. DiviTrain is not responsible for temporary platform outages caused by the Content Provider, changes to course content or catalogue, or third-party services embedded in the portal. DiviTrain will make reasonable efforts to communicate significant disruptions and to facilitate resolutions.


10. Disclaimer of Warranties

The platform and all content are provided "as is" and "as available" without warranty of any kind. We do not warrant that the platform will be uninterrupted or error-free, or that course content is continuously available. Some jurisdictions do not allow exclusions of implied warranties; in such cases these exclusions apply to the maximum extent permitted by law.


11. Limitation of Liability

DiviTrain's total liability to you for any claim arising from a purchase shall not exceed the amount you paid for that specific order. This limitation does not apply to claims for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by mandatory law.


12. Export & Sanctions

DiviTrain does not provide products or services to persons or entities on applicable sanctions lists (including EU, UN and OFAC lists). By purchasing, you confirm you are not subject to any such sanctions.


13. Governing Law & Disputes

13.1. Governing Law: These Terms are governed by Dutch law.

13.2. Disputes: Any dispute shall first be submitted to DiviTrain via support@divitrain.com. If unresolved, disputes shall be submitted to the competent court in the Netherlands, without prejudice to your right to use an alternative dispute resolution body in your country of residence.

13.3. EU Online Dispute Resolution: EU consumers may use the European Commission's ODR platform: ec.europa.eu/consumers/odr

13.4. Mandatory local rights: Mandatory consumer protection laws of your country of residence remain unaffected by this clause.


14. Changes to These Terms

DiviTrain reserves the right to update these Terms. Changes take effect upon publication on our website and apply to new orders only. Existing orders are governed by the Terms in force at the time of purchase.

PART 2 — Business Terms of Sale (Companies & Teams)

These Business Terms of Sale apply exclusively to purchases made by legal entities, partnerships or sole traders acting in a professional or business capacity ("Customer"). By placing an order, the Customer confirms it is acting in such capacity. These Terms take precedence over Part 1 (Consumer Terms of Sale) for all B2B transactions.

1. Definitions

Voucher: A unique, single-use redemption code purchased by the Customer and distributed to individual End Users. Each Voucher entitles one End User to create their own portal account and access one Product.

Product: A time-limited licence to access online IT training content via the DiviTrain portal, unlocked by redeeming a Voucher.

Content Provider: The party that prepares, hosts and delivers the training content accessible via the DiviTrain portal.

End User: The individual employee or contractor of the Customer who redeems a Voucher, creates their own portal account and accesses the training content.

Account Manager: The individual appointed by the Customer to manage Voucher distribution and act as point of contact with DiviTrain.

Redemption: The moment an End User enters a Voucher code on the DiviTrain portal and creates their personal account. Each Voucher can only be redeemed once.

Activation: The moment an End User starts their first course after Redemption. A notification is shown in the portal before this occurs.

Access Period: 365 consecutive calendar days per Voucher, beginning at Activation.

Exam Voucher: Not included in any Product unless explicitly stated in the order. Exams must be booked separately via Pearson VUE or another authorised exam provider.


2. What the Customer Is Purchasing

The Customer purchases one or more Vouchers — each entitling one End User to access online IT training content on the DiviTrain portal. The Customer is not purchasing:

  • Downloads or permanent ownership of content;
  • Exam vouchers or exam registrations;
  • Consultancy, custom content or dedicated instruction;
  • Any guarantee of certification or exam pass.

There is no minimum or maximum order quantity. Vouchers are non-refundable once redeemed (see Section 8).


3. Ordering Process

3.1. Small orders (1–4 Vouchers): Orders may be placed directly via the webshop at www.divitrain.com.

3.2. Larger orders (5 or more Vouchers): The Customer is invited to request a quote via email at support@divitrain.com or via the contact form on the website. DiviTrain will issue a written quote within 2 business days. Quotes are valid for 14 days from the date of issue.

3.3. Order confirmation: An order is binding upon written confirmation by DiviTrain following acceptance of the quote, and upon receipt of payment. DiviTrain reserves the right to request a purchase order number before issuing an invoice.

3.4. Prices: All quoted prices exclude VAT unless stated otherwise. The applicable VAT treatment is described in Section 9.


4. Delivery of Vouchers

Upon receipt of payment, DiviTrain will deliver the Voucher code(s) to the email address provided by the Customer, typically within 1 business day of payment being confirmed.

For orders of multiple Vouchers, all codes are delivered to the Account Manager in a single summary email. The Customer is solely responsible for the secure storage and correct distribution of Voucher codes to its End Users.

Delivery is deemed complete when the Voucher code(s) email is sent. DiviTrain is not responsible for non-delivery caused by incorrect email addresses provided by the Customer.

Important: Voucher codes are valuable. Treat them like gift cards. DiviTrain cannot replace codes that have been lost, shared with unintended recipients or redeemed by an unauthorised person as a result of the Customer's negligence.


5. Redemption & Account Creation

Each End User redeems their Voucher independently on the DiviTrain portal by entering the Voucher code and creating a personal account with their own credentials. DiviTrain does not create accounts on behalf of End Users.

Each Voucher is single-use and expires upon Redemption. Once redeemed, the Voucher code is no longer valid and cannot be transferred.

The Customer is responsible for ensuring that each Voucher is distributed to the intended End User only.


6. Activation & 365-Day Access

After Redemption, the End User's 365-day Access Period begins at Activation — the moment the End User starts their first course. A notification is displayed in the portal before the first course starts so the End User can make an informed decision.

Important: The 365-day clock starts at Activation, not at Redemption. End Users should be ready to begin learning before starting their first course.


7. No Right of Withdrawal

The statutory right of withdrawal under the EU Consumer Rights Directive does not apply to B2B contracts. Orders confirmed and delivered are binding.

Cancellation of an order before Voucher codes are sent may be requested by contacting support@divitrain.com; DiviTrain will assess this at its discretion.


8. Refund Policy

  • Payment received — Voucher codes not yet sent: Full refund upon request.
  • Voucher codes sent — not yet redeemed: Assessed case by case; contact support@divitrain.com within 7 days.
  • Voucher redeemed — first course not yet started: Assessed case by case; contact support@divitrain.com within 7 days of Redemption.
  • First course started (Activation): No refund possible. The digital content has been consumed from that moment.
  • Course entirely unavailable due to Content Provider: Comparable replacement or pro-rata credit for the unused portion of the Access Period.
  • Verified technical defect preventing access after Redemption: Full credit or replacement after verification with the Content Provider.

Refund or credit requests must be submitted to support@divitrain.com with the order number and the affected Voucher code(s).


9. Payment Terms & VAT

9.1. Payment method: Payment is made by bank transfer to the bank account details stated on the DiviTrain invoice. Payment is due within 14 days of the invoice date, unless a different term is agreed in writing. Vouchers are not delivered until full payment has been received and confirmed.

9.2. Late payment: Overdue amounts automatically accrue statutory commercial interest in accordance with Dutch law (Wet handelsrente) from the due date. DiviTrain reserves the right to charge reasonable collection costs. DiviTrain may withhold undelivered Vouchers for overdue accounts until payment is received.

9.3. VAT — EU customers: DiviTrain is a VAT-registered business in the Netherlands. For B2B sales to customers established in other EU member states, VAT is reverse charged to the Customer under Article 196 of the EU VAT Directive. DiviTrain will issue a VAT-exempt invoice stating "Reverse charge — VAT to be accounted for by the recipient" and the Customer's VAT number. The Customer is required to provide a valid EU VAT number at the time of ordering. If no valid VAT number is provided, DiviTrain reserves the right to charge Dutch VAT at the applicable rate.

9.4. VAT — non-EU customers: For customers established outside the European Union, the supply of digital services falls outside the scope of Dutch VAT. No Dutch VAT will be charged. The Customer is solely responsible for any VAT, withholding tax, sales tax or other taxes applicable under the laws of their country.

9.5. VAT numbers: The Customer warrants that any VAT number provided is valid and current. DiviTrain may verify EU VAT numbers via the VIES system. If a VAT number is found to be invalid after invoicing, the Customer remains liable for any resulting VAT amount.


10. Voucher Usage Rules

Each Voucher is for single use by one individual End User only. The Customer agrees not to:

  • Resell, sublicense or publicly distribute Voucher codes;
  • Use a single Voucher for multiple users;
  • Allow End Users to share portal accounts created via Voucher Redemption;
  • Copy, record, reproduce or redistribute any training content accessed via the portal.

Violation of these rules may result in immediate deactivation of affected accounts and portal access without refund.


11. Intellectual Property

All training content is owned by or licensed to the Content Provider and/or the underlying content publishers. DiviTrain owns its brand assets and portal configuration. These Terms grant no intellectual property rights to the Customer or its End Users. End Users may not copy, record, reproduce, redistribute or create derivative works from the content.


12. Content Provider & Platform

Training content is hosted and delivered by the Content Provider via the DiviTrain portal. DiviTrain is not liable for platform outages caused by the Content Provider, changes to course content or catalogue, or discontinuation of specific courses. In the event of material unavailability of a purchased course, DiviTrain will offer a comparable replacement. If no replacement is available, DiviTrain will issue a pro-rata credit for the unused portion of the Access Period.


13. Limitation of Liability

DiviTrain's aggregate liability to the Customer shall not exceed the total amount paid by the Customer for the specific order giving rise to the claim. DiviTrain is not liable for indirect, consequential or economic loss, including loss of profit, revenue, data or business opportunity. This limitation does not apply to claims arising from fraud or wilful misconduct.


14. Export & Sanctions

The Customer confirms that neither it nor its End Users are subject to any applicable export restrictions or sanctions (EU, UN, OFAC or equivalent). DiviTrain reserves the right to cancel orders that would violate applicable sanctions regulations.


15. Confidentiality

Both parties agree to keep commercially sensitive information exchanged in connection with an order confidential and not to disclose it to third parties, except as required by law or with the other party's written consent.


16. Governing Law & Disputes

16.1. Governing Law: These Terms are governed by Dutch law. The UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

16.2. Disputes: Disputes shall first be submitted to DiviTrain via support@divitrain.com. If unresolved, disputes shall be submitted to the competent court in the Netherlands, unless both parties agree in writing to an alternative dispute resolution mechanism.


17. Changes to These Terms

DiviTrain reserves the right to update these Terms. Updated Terms apply to new orders only. Ongoing orders remain subject to the Terms in force at the time of order confirmation.
